The split continues on whether it's appropriate for lawyers to use coupons to offer discounts or "free initial consultations" to prospective clients. Ohio in December 2005 joined those states finding coupons unethical. Note that it's proper to advertise that the initial consultation is free; the lawyer just can't do it with a coupon.
Why, you might ask. Is the person likely to be misled by a coupon? Nope. Is it unsavory for lawyers to do so? Nope. Guess again: while the lawyer can advertise that the initial consultation is free, she cannot use a coupon, because that suggests that the rate is special. So, in Ohio, apparently a lawyer either has to give everyone a free initial consultation, or no one.
What purpose does that serve?
