Democrats apparently will be using Samuel Alito's non-recusal in the Vanguard case as one the key points of attack on Alito during the upcoming hearing. My take? Unless some new evidence or legal theory pops up, that particular incident isn't grounds to doubt Alito's integrity. The incident wasn't a violation of judicial ethics, unless we give new, expansive readings to the legal standards. And there was neither motive nor opportunity for Alito to benefit himself. Alito has had a long public career. We ought to evaluate his ethics on the basis of that career, not on the basis of the Vanguard affair.
