David Iglesias testified before Congress that he believes Senator Pete Domenici leaned on him to issue indictments against prominent Democrats before an election, presumably to help the Republicans win. I have written a separate post on Senator Domenici's end of the telephone call at issue.
New Mexico has a standard MR 8.3 requirement that lawyers report violations of the rules that raise a substantial question as to the fitness of another lawyer to practice law. In my other post I explain why the call might satisfy that requirement. Mr. Iglesias' has testified to his belief that the call was improper.
Mr. Iglesias did not report the call to the Justice Department, however. Presumably he did not report it to the New Mexico bar. He is reported to have testified that he kept quiet out of loyalty to Mr. Domenici. That is not an exception to Rule 8.3.
It will be interesting to see what the New Mexico bar does with this aspect of the question, as well.
