A poorly researched article is here. On the contentious topic of advance waivers, the article is a caricature. In a complicated world, both corporate clients and law firms need to be able to discuss advance waivers and reach agreement -- or not -- on whether to enter into them. I quite frequently ask corporate counsel if they favor a rule banning them from entering into advance waivers and in my experience the universal reply is "I don't want a ban, but I do want the waiver to be conspicuous, and clear, and I want to be able to decline to sign a fee agreement if I don't like the waiver." (I'm not advocating that advance waivers be enforceable against Joe and Jane Consumer.)
