UPDATE: Jonathan Adler, at Volokh, takes up the question and one of his commenters, Steve, added this comment in good humor, “In the history of the Supreme Court, there may be no Justice who has included so many good lines in so many hopeless dissents as Justice Scalia. He may have lost 8–1 on the question of whether equitable tolling is available under the AEDPA, but he sure stuck it to those amici!” Not surprisingly, I side with the amici over Justice Scalia on this one.
