At the recent ILECIV conference one of the final plenary sessions was on the jurisprudence of legal ethics. The panelists - Tim Dare, Kate Kruse, Daniel Markovits, Steve Pepper, Bill Simon, Brad Wendel and I - were given a set question: Is the concern of legal ethics the morality of lawyers, the morality of clients or the morality of laws? We each wrote a 3-5 page paper on the question prior to the session. At the session, David Luban, who had read all of the papers, posed questions to each/all of us to elicit discussion on the topic. The session was a blast for the participants, and (we hope) also rewarding for the audience.
The papers written for the panel are going to be published in revised form in the journal Legal Ethics. They are currently posted in their original form on SSRN, here: The Concerns of Legal Ethics.
And here's my first pitch - of many. ILECV is going to be in Banff, Alberta, on July 12-14, 2012. I will be hoping for full LEFer attendance.
