The ABA's Commission on Ethics 20/20 released two issues papers this afternoon. One deals with confidentiality-related ethics issues arising from lawyers' use of new technology, including cloud computing.
The second paper identifies a variety of ethics issues arising from lawyers' use of Internet-based client development tools, such as social and professional networking sites, blogging, pay-per-click (and pay-per lead) advertising, and law firm websites. (Regarding law firm websites, the paper indicates that the ABA will be releasing a new formal opinion on the subject at the end of this week.)
Both papers seek comments and feedback on the issues that are identified. As one of the Commission's reporters, I am particularly interested in reactions to the two papers and encourage people to submit comments to the Commission by contacting Natalia Vera. In addition, people are welcome to offer testimony at the Commission's public hearing in October (see here).
