The memo hasn't been leaked, but it's existence is being discussed at The Atlantic and elsehwere. Between this memo and the so-called torture memos, we're continuing to see that the content of government lawyers' memos can mean life or death. This entire field of lawyering is the subject of the Lawfare blog and Jack Goldsmith has a post calling for the Obama administration to reveal the reasoning in the memorandum.
