The Commission has released a discussion draft of a possible proposal to amend Model Rule 5.4. The discussion draft identifies changes that, if formally proposed and adopted, would allow for very limited forms of nonlawyer ownership in law firms. The document can be found here, and a brief overview is here. Notably, the Commission is not formally proposing a change to Model Rule 5.4 at this time. Rather, the Commission is seeking feedback in order to determine whether it should make such a proposal.
The Commission also has released proposals concerning choice of law problems that arise due to inconsistencies among jurisdictions, both domestically and internationally, with regard to nonlawyer ownership in law firms. The cover memo is here, and the accompanying proposal is here.
