We previously discussed the NYT interview with Justice Ginsburg, following up on Paul Horwitz's post at Prawfsblawg. In the comments I suggested that her criticism of an activist court lacked punch. Kenneth Jost analyzes the cases in which the Roberts court struck down statutes, finds that Justice Ginsburg joined half of them, and finds that the current court strikes down statutes at much smaller rates than recent courts.
