On January 25, 2017, the Illinois Supreme Court announced adoption of new rule provisions related to proactive management-based regulation (PMBR). The press release can be found here. The rule revisions require that uninsured attorneys complete a confidential self-assessment process. Australian states have successfully used PMBR and Canadian provinces are exploring different approaches to PMBR. For an analysis of PMBR in Australia, see my co-authored empirical study. With PMBR, the regulator works with lawyers to address risks to avoid problems, rather than reacting to attorney misconduct after it has occurred. Adoption of PMBR in Illinois is a welcome move, advancing public protection.
